Court to Reexamine Ruling That Permitted Trump to Send Military Forces to Oregon City

Judicial Panel Concurs to Reconsider Case

The ninth circuit court of appeals decided on this week that it would reexamine the legal dispute concerning the executive power with an larger group of 11 judges. The judicial body also vacated a earlier decision from a three-judge panel that had supported the administration.

Legal Saga Over Troop Deployment

This legal directive represents the latest development in a protracted legal battle over whether the former president has the authority and valid reason to deploy state military units in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to months of protests.

Differing Viewpoints

The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while city and state officials maintain that local officers have command of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, residents have been posting footage of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in the city issued two legal injunctions this month – one preventing the federalization of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after efforts to evade the initial injunction by mobilizing out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

En Banc Review

The latest ruling means the matter will be heard “en banc” – with both rulings under consideration simultaneously – by a group of 11 judges.

“This ruling demonstrates that facts are important and that the judicial system are striving to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The court is sending a clear message: the president cannot send the military into US cities without cause. We will continue defending state legislation, principles, and autonomy as this legal proceeding moves forward and our fight continues in the judicial system.”
