The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis sparked by the presentation of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The succession of conflicting incidents captured the bleak nature of the outgoing year. By day, political struggles are conducted: optimistic declarations are released from multiple capitals. Considerable effort is allocated on restraining particular approaches. By night, Moscow brutally reminds the world that, for them, military action persists as the main instrument for achieving "peace".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor missile launches from enemy soil, a ability enabled by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to counter approaching aerial threats flew past – modern combat jets provided to Ukraine by NATO members.

Moments later, Kyiv's air-defence systems engaged: defensive missiles fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, probably supplied through partner states. Every deployment jolts you unexpectedly, rattling buildings. The moment of terror quickly transforms into sober acceptance: possibly the hostile projectile won't hit its mark this time, protecting urban areas from ruin and another blackout.

Ongoing Risks

Not long after, a large-caliber weapon fired at a unmanned aircraft somewhere nearby, part of a rapid response unit – most likely allied-provided weaponry. Unfortunately, the shots failed to hit the opposing UAV – it pressed on overhead toward its target.

With pauses, this carried on until dawn. Kyiv greeted the morning news: several casualties, damage and infrastructure problems in numerous residences as a result of the night's assault. As typically, everyone still continued their routines – living the war. But those entire period demonstrated Ukraine's critical military reliance on international aid – a reliance that neighboring countries are demonstrably unable to substitute in the near term.

Failed Diplomacy

The detailed framework from Washington provoked deep reactions, debate and profound anxiety – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after prior negotiation attempts and multilateral gatherings.

Every new initiative from Washington follows the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They contain the crisis but never actually win the battle. This trend will, undoubtedly, persist.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. Washington operates on a assumption understood by experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is unrealistic to force Russia to surrender the land that it currently occupies in Ukraine's south or east.

The problem is that while acknowledging this situation, American administration does minimal to prevent Kremlin actions, through diplomacy or military means, from believing that the situation will not shift further in its benefit in the near future.

Divergent Views

Therefore, the Kremlin is certain that time is on his side – that Ukraine and its partners are approaching exhaustion. Their motivation to sign a deal that does not give them the maximum possible gain is almost completely absent. There may be numerous efforts to end hostilities, but they will continue as long as Russia's leader remains supremely confident in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, gradually sacrificing civilians and areas but averting a total frontline collapse until conditions improve in its benefit.

Present Conditions

Realistically, there are no real preconditions for a ceasefire. Now, personal considerations are becoming relevant: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unworkable, so that their priority does not shift toward homefront challenges. And although their task will now be considerably more difficult after latest incidents, it remains quite doubtful that this will change their overall approach.

These opposing factors are influencing discussions.

Summary and Prospects

It took a mere seven days to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of negotiators, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter political attacks from Washington that are rooted in Kremlin requirements and reflect specific hesitation to alter the situation, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the foreseeable future, primarily depend on continued Western support.
